A. Definitions Of Terms

  1. By placing an order, you (sometimes referred to herein as “Client”) are agreeing to commission Products Photography to create and deliver photography services and images to you and you are agreeing to be bound by the following terms and conditions (“Terms of Service”). The services offered under the Terms of Service include various photography services and Images, which means all viewable renditions furnished by hereunder, whether captured or stored in photographic magnetic, optical, or any other medium whatsoever.

  3. We have reserved the right to update and change the Terms of Service by posting updates and changes to the our website. You are advised to check the Terms of Service from time to time for any updates or changes that may impact you.

  4. By placing your order with Peli-cam, you acknowledge that you have read, agree with and accept all of the terms and conditions contained in this Terms of Service agreement.

  5. For purposes of these terms “Objective Shooting Criteria” means camera position, product position, number of items per shot, shot distance, product rotation and camera height.

B. Ordering 50 Photos Or Less

  1. For Orders of 50 images or less, payment is due in full at the time the Order is placed and must be made though e-mail or contact form on our website. Every assignment that has been discussed orally will be notified by e-mail and an answer must be given to make the assignment binding. We are not obliged to start the work before this agreement has been approved. 

  2. For Orders greater than 50 images, Peli-cam will send an estimate of costs and contract for execution to Customer which must be approved prior to the Order being placed. Large orders are extensively discussed and processed within our team. These discussions almost always take place in a meeting or online conversation before. Think of Skype or Facetime programs. Every assignment that has been discussed orally will be notified by e-mail and an answer must be given to make the assignment binding.
     

Changing the assignment

  1. If the pre-agreed agreements do not match the amount of products received, we will contact the customer. The customer is required to indicate in advance which products should be photographed and in what way. We will indicate this in the event of uncertainty. 

  2. In case of miscommunication. Because situations like this have an impact on the pre-specified deadline, we want to indicate that we cannot be held liable for a missed deadline. The responsibility concerning the amount, the way the photo is taken, and the deadline lies with Peli-cam. Every interruption of the work process and its consequences lie with the customer. 

  3. If the situation occurs while the assignment is being changed while Peli-cam is working on it, one of these steps will be taken:

    • a. Research will start. Can the new work be done within the stated quotation. If yes: invoice stays the same. 

      b. The process will start from the beginning with all previous work being invoiced. 

      c. The work created will be completed. Planning will change to newly discussed plan. Quotation will change to new price.

​Image Approval / Disapproval Policy

Approval/Disapproval

Customer will be given an opportunity to approve or disapprove images at the conclusion of the photoshoot, and only after all selected images are shown.

 

Failure to respond for any reason within 14 days to the presentation given by Peli-cam will result in those images being automatically approved. 

 

Once an image is approved by the customer, than no future refunds can be issued or complimentary redos, retouching or changes are allowed.

 

In the event Customer disapproves of an image, the following requirements must be satisfied:

 

a. Disapproval must be expressly made to Peli-cam in writing specifying the objective reasons for disapproval. Because photography is a visual medium, it is advised to use visual mark-ups as described in the following article.

 

b. If Customer has complied with the Peli-cam terms & conditions, and Peli-cam has failed to substantially match the objective shooting criteria pursuant to the instruction given by Customer. Also, the Customer provided materials (which include, but are not limited to “comps,” drawings, illustrations, tear sheets, cell phone images, and reference urls), Peli-cam will photograph or retouch the disapproved images up to two times complimentary. 

 

c. If Customer has not complied with the Peli-cam terms & conditions or has otherwise left image composition up to the discretion of Peli-cam, then Customer will not be entitled to a refund or reshoot and any refunds or reshoots will be offered in Peli-cam’s sole and absolute discretion.

 

If Customer requests a reshoot or Redo because of their dissatisfaction with lighting elements of an image, then Peli-cam will attempt to fix the image using retouching at no additional cost.

If Peli-cam has reshot or retouched an image twice and Customer still disapproves of the image and the image still fails to meet the Objective Criteria of the Materials provided by Customer, then Peli-cam will work with Customer to find a mutually acceptable remedy.

If the image cannot be sufficiently corrected to Customer’s satisfaction using retouching then the lead photographer will, at his or her sole option, have the choice to reshoot the image complimentary or charge the Customer for the cost of a new photo.

The use, display or other dissemination of any image created by Peli-cam shall constitute Customer’s acceptance and satisfaction of the image(s) at which time Customer shall be entitled to no further remedy for dissatisfaction with the provided image(s).

Peli-cam expressly retains all copyright and other intellectual property rights to all disapproved and refunded images, and any use, display, or other dissemination of disapproved or refunded images by Customer is strictly prohibited.

Once an order is refunded than that part of the order is closed and no further adjustments or changes can be made.

Product Quality

To ensure Peli-cam is able to produce the highest possible quality image, Customer agrees that all products provided for shooting will be in substantially similar condition as those appearing in the Customer provided Materials. This includes, but is not limited to color, size, label position and content, packaging, etc.

Peli-cam is not responsible for any damage or loss to products provided by Customer to Peli-cam for photographing unless such damage or loss occurs while the product(s) is in actual physical possession of Peli-cam.

Customer agrees that Peli-cam will photograph the item in the condition in which it arrives at the Peli-cam studio. In the event the product arrives at the Peli-cam studio in a condition which does not materially match that which is evidenced in the Customer provided Materials, Peli-cam will use reasonable efforts to contact Customer and request a new sample product more closely matching that appearing in the Materials. However, Peli-cam is not liable for photographing the product as received. Any Customer disapproval will be subject to the Peli-cam Refund, Revision, Image Approval/Disapproval Policy.

In the event a provided product contains minor flaws (i.e. minor discoloration, dings, dents, scuffs, etc.) Peli-cam may, at its option retouch the images at no additional cost to Customer, however it is under no obligation to do so.

Props are defined as items other than the product to enhance the photo. Props chosen by Peli-cam or chosen by Costomer are invoiced to the Customer after agreeing. 

Customer must provide all propslist for the photograph or fully let Peli-cam decide what kind of props are used.
